Property Damage After a Motor Vehicle Accident

CAR ACCIDENT PROPERTY

DAMAGE LAWYER.

Don't get bullied by insurance companies. We have your back.

Traffic accidents are all too common in New York City, and often, they result in personal injury and the destruction of property. When it comes to property damage, the insurance company of the negligent driver may push back against your claim. Moreover, New York’s no-fault laws may also work in favor of the insurance company’s denial of your claim’s full value. When that happens, it’s time to consult with a trusted car accident property damage lawyer.

At Moshes Law, we help clients recover compensation for personal property that was damaged or destroyed in a car accident. This property can be your vehicle itself, or other things, such as laptops, mobile devices, and other items of value. Additionally, you may be eligible to file a claim if a motorist caused damage to your home if, for example, a driver crashes into your fence or otherwise damages your property.

WHAT TO DO BEFORE CALLING AN ATTORNEY FOR VEHICLE PROPERTY DAMAGE.

In New York, the statute of limitations to file a claim is three years. However, it’s always advantageous to speak with an attorney as soon as you can after an accident. Make sure you call us before you give a statement to the insurance company
Building up a strong case is critical in any legal action. This is true for property damage claims as well. We need to have all available evidence to support your claim. What this means will vary from case to case. But in general, keep these things in mind before you contact our attorney for vehicle property damage

THE DO'S AND DON'TS
WHEN INJURED IN AN ACCIDENT.

DO'S:

DO SEEK MEDICAL ATTENTION

Prioritize your health and safety by seeking immediate medical care after an accident, even if you feel fine. Some injuries may not be apparent right away.

DO CALL THE POLICE

Report the accident to the authorities, as they will document the incident and create an official record.

DO GATHER INFORMATION

Collect contact information from all parties involved in the accident, including witnesses. Take photos and videos of the accident scene, injuries, and any property damage.

DO DOCUMENT YOUR INJURIES

Keep a record of your injuries, symptoms, and medical appointments. This documentation will help support your personal injury claim.

DO PRESERVE EVIDENCE

Keep any relevant physical evidence (e.g., damaged clothing or vehicle parts), and store digital evidence (e.g., photos or videos) in a secure location.

DO CONTACT A PERSONAL INJURY LAWYER

Consult with an experienced lawyer to protect your rights and help navigate the legal process. Let Moshes Law hold your hand through this process every step
of the way.

DON'TS

DON'T ADMIT FAULT

Avoid making any statements that could be interpreted as admitting fault or liability, as this may be used against you.

DON'T DELAY SEEKING MEDICAL CARE

Failing to see a doctor promptly can not only worsen your injuries but also weaken your claim, as insurers may argue that your injuries were not serious.

DON'T SIGN ANYTHING WITHOUT LEGAL ADVICE

Insurance adjusters may try to pressure you into accepting a low settlement offer. Consult with your lawyer before signing any documents or agreeing to a settlement.

DON'T OVERSHARE ON SOCIAL MEDIA

Posting about your accident or injuries on social media can provide the opposing party with information they can use against you. Keep your accounts private and avoid discussing your case online.

DON'T SETTLE WITHOUT CONSIDERING FUTURE EXPENSES

When negotiating a settlement, consider the long-term financial impact of your injuries, such as ongoing medical treatment, lost wages, or future care needs.

HOW LONG AFTER A CAR ACCIDENT CAN YOU CLAIM FOR DAMAGE?

As previously stated, the statute of limitations in New York is three years. However, there are other filing deadlines that you should know:

· IF THE VALUE OF THE DAMAGE EXCEEDS $1,000

- You must notify the DMV within 10 days of the accident using Form MV-104

· TO CLAIM NO-FAULT COVERAGE THROUGH YOUR INSURANCE COMPANY

- You must file your claim within 30 days of the accident.

· CLAIMS AGAINST A MUNICIPALITY OR GOVERNMENT ENTITY

- You must file within 90 days of the crash.

· CLAIMS WHERE A VICTIM HAS A MENTAL ILLNESS

- In these cases, the statute of limitations may be extended once a mental health professional declares the victim incapable of currently filing a claim

Hired Yuri to help me through coop purchase process. Yuriy and his staff answered all my questions promptly, I've had attorneys in the past that once paid would take their time and de prioritize your mails, etc..Not the case here. My initial purchase wound up folding week before scheduled closing date due to seller negligence. Almost a year later, I received same level of effort from Yuriy second time around, closed, and am very happy with professionalism and expertise provided.
